1. Definitions

• Beta Testing: Experimental phase of software development where selected users test pre-release software for bugs, usability, and functionality.
• Licensed Thai Exchange: Cryptocurrency exchanges that are legally licensed to operate in Thailand by the Securities and Exchange Commission (SEC) of Thailand, such as BitKub, Bitkub Pro, Satang Pro.
• Software: The grid trading software developed and operated by Super8Trends to enable Users to trade cryptocurrencies on licensed Thai exchanges through automated strategies.
• Super8Trends: Super8 Trends Co. Ltd, a company incorporated under the laws of Thailand, which owns and operates the grid trading software. The company is registered with Thailand Company Number - 0845563003046. The company's registered office is at IT Samui Complex, 4th Floor, Office 44, 142/17 Moo 4, Maret, Lamai, Koh Samui, Surat Thani, 84310, Thailand.
• User(s): Individual private person(s) who are residents of Thailand making use of the Website or Software for beta testing purposes. Users are also referred to as "you".
• Non-Custodial Service: The Super8Trends software never takes custody of your cryptocurrency assets. All trades executed via the Software occur on your linked licensed Thai exchange account, which remains under your control.
• User-Controlled Trading: Super8Trends does not independently make investment decisions on your behalf. The Software will only execute trades based on the grid trading strategy and parameters that you select and activate.

2. Nature of Service and No Advice

Super8Trends (the "Software") is a non-custodial, user-directed beta testing tool that enables you to test grid trading strategies on supported licensed Thai cryptocurrency exchanges. You retain full control over your exchange account and funds at all times; Super8Trends never holds or has access to your assets or your private keys. The Software executes trades only according to the parameters you set during testing, and Super8Trends has no discretionary authority to manage your investments.

Accordingly, Super8Trends does not provide investment advice or asset management services to any user. We are a technology provider developing software for testing purposes, not a licensed digital asset business operator (exchange, broker, or dealer). Using Super8Trends is not a substitute for personal judgment or independent financial advice, you are solely responsible for your trading decisions and the configuration of the Software during beta testing.

3. Beta Testing Application and Account

1. To participate in beta testing, you must apply through our website https://www.super8trends.com and be approved for the beta testing program.
2. You must be a legal resident of Thailand and provide verification of your residency status.
3. You must have active accounts with licensed Thai cryptocurrency exchanges as approved by Thailand's SEC.
4. You must protect the login details of your beta testing account and keep your password strictly secret. We will assume that all actions taken from your account are done by you or under your supervision.
5. You agree to provide up-to-date, complete and accurate information on your account. You agree to promptly update your beta testing account when necessary, so that we can contact you if needed.
6. Super8Trends beta testing does not onboard or provide services to entities located in, established in, or residents of countries other than Thailand.

4. Beta Testing Terms and Fees

1. Beta testing access is provided free of charge during the testing phase. No commercial fees apply during beta testing.
2. Beta testing is experimental and may be discontinued at any time without notice.
3. Beta testing participants acknowledge that the software is in development and may contain bugs, errors, or unexpected behaviors.
4. Commercial pricing, if any, will be communicated separately before any commercial launch.

5. User Account at Licensed Thai Exchanges

1. For Software to function during beta testing, you are required to add API Keys from licensed Thai cryptocurrency exchanges to our beta testing platform. These exchanges must be licensed by Thailand's SEC.
2. You are solely responsible for management of your account at licensed Thai cryptocurrency exchanges and any agreement with these exchanges.
3. You are solely responsible for ensuring any API Keys added to the beta testing platform have no withdrawal permissions from your exchange accounts and that all withdrawal options are disabled.
4. The beta testing software does not require withdrawal permission on your exchange accounts to function and Super8Trends is not responsible for any withdrawals on your exchange accounts.
5. Supported exchanges during beta testing include only those licensed by Thailand's SEC, such as BitKub, Bitkub Pro, and Satang Pro.

6. Fair Use of Beta Testing Platform

1. By participating in beta testing, you declare to be at least 18 years old and a legal resident of Thailand.
2. You may not use the beta testing platform in such way that you violate Thailand law or any other applicable laws and regulations.
3. As a condition for beta testing participation, you agree not to provide any information, data or content that is false, misleading, incorrect, inaccurate, incomplete or that violates any law or regulation.
4. During beta testing, you agree that you will not, nor allow third parties to:
   • Enter any non-public / secure areas of the Website or Software
   • Send viruses, worms, junk mail, spam, chain letters, unsolicited offers or ads
   • Investigate, scan or test the Website or Software or violate any security or authentication
   • Use any automated systems to withdraw data from the Website ("screen-scraping")
   • Make and distribute copies of the beta testing software
   • Attempt to sell, distribute, copy, rent, sub-license, loan, merge, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange, translate, hack, distribute, harm or misuse the beta testing platform
   • Create derivative works of any kind whatsoever
5. You may not create an account under someone else's name or misrepresent your identity.
6. If you receive personal data or other sensitive information from other beta testers, you will keep this information confidential.
7. Super8Trends is entitled to (temporarily or permanently) terminate your beta testing access if we suspect abuse or non-compliance with these Terms.

7. Privacy

Super8Trends respects your privacy during beta testing. When you participate in our beta testing program, we will collect certain personal data from you. In our Privacy Policy you can read which personal data we collect and for what purposes. You can find our privacy policy at: https://www.super8trends.com/privacy.

8. Intellectual Property

1. Super8 Trends Co. Ltd is the exclusive owner or licensee of all intellectual property rights in and relating to the Super8Trends software and the content available through the Website and the Software, including patents, patent applications, trademarks, trademark applications, database rights, service marks, trade names, copyrights, trade secrets, licenses, domain names, know-how, property rights and processes.
2. Super8Trends grants beta testing participants a non-transferrable, non-exclusive, non-sublicensable and revocable license intended for beta testing purposes only. You are not allowed to access the content of the Website and Software for any commercial purpose during beta testing.

9. Availability and Beta Testing Disclaimers

1. The beta testing platform is provided on an experimental basis. Super8Trends will use reasonable efforts to make the beta testing platform available, but acknowledges this is experimental software that may experience downtime, bugs, or unexpected behaviors.
2. Super8Trends does not accept any responsibility for unavailability of the beta testing platform, or any difficulty or inability to download or access content, or any other system failure during beta testing.
3. Super8Trends is not responsible for any support or maintenance during beta testing. Super8Trends may update, modify, or adapt the beta testing platform at its own discretion to enhance the testing experience.
4. To the maximum extent permitted by applicable law, Super8Trends hereby disclaims all implied warranties regarding the availability of the beta testing platform. The platform is provided "as is" and "as available" without warranty of any kind during the testing phase.

10. Beta Testing Feedback and Support

1. Super8Trends encourages beta testers to provide feedback about the software functionality, bugs, and user experience.
2. Beta testing participants may receive limited support through designated channels for software-related questions only.
3. Super8Trends explicitly does not provide:
   • Personal trading advice or recommended settings
   • General or personal financial advice
   • Investment recommendations
4. Any tutorials, videos and examples provided during beta testing are for demonstration and education purposes only.
5. All use of beta testing materials is at the sole risk of the participant.

11. Risks

1. Beta testing participants are aware of the accompanying risks of possessing, trading and using cryptocurrencies and take full responsibility for these risks.
2. Beta testing involves experimental software that may contain bugs, errors, or unexpected behaviors that could result in trading losses.
3. All beta testing is conducted at the participant's own risk with the understanding that this is pre-release software.

12. Liability

1. Nothing in these Terms shall exclude or limit Super8Trends's liability when it cannot be excluded or limited under applicable Thai law.
2. Super8Trends is not liable to you for any (direct or indirect) damage you suffer as a result of participating in beta testing, including but not limited to:
   • Software bugs, errors, or unexpected behaviors
   • System downtime or unavailability
   • Trading losses resulting from beta testing participation
   • Any failure of the experimental software
   • Loss of data or trading history during beta testing
3. To the maximum extent permitted by Thai law, Super8Trends expressly excludes liability for any indirect, special, incidental, or consequential loss or damage suffered during beta testing.
4. Super8Trends supplies access to beta testing software "AS IS" and does not warrant that the software will be free from error, virus or other defect during the testing phase.
5. Under no circumstances shall Super8Trends be liable for any loss, damage arising from beta testing participation. To the fullest extent permitted by law, all other warranties, statutory or implied, are excluded during beta testing.

13. Indemnification

Beta testing participants will indemnify, defend, and hold Super8Trends harmless from and against all liabilities, damages and costs (including settlement costs and legal costs) arising out of third party claims regarding:

1. Any injury or damages resulting from behavior of that participant related to beta testing participation; and
2. Breach by that participant of these Terms or violation of any applicable law, regulation or order during beta testing.

14. Termination of Beta Testing

1. Beta testing participants may withdraw from beta testing at any time by notifying Super8Trends.
2. Super8Trends may choose to terminate beta testing access for any participant for violation of these terms or any other reason Super8Trends deems in the best interest of the beta testing program.
3. Super8Trends may discontinue the entire beta testing program at any time without notice.
4. Upon termination of beta testing, all access to the software will be revoked and any data may be deleted.

15. No Refund Policy for Beta Testing

As beta testing is provided free of charge, no refunds are applicable. Any trading losses incurred during beta testing are solely the responsibility of the participant.

16. Beta Testing Data and Information

1. Any content provided through beta testing is intended for testing and educational purposes only. It is very important to do your own analysis before making any trading decisions.
2. You should take independent financial advice from a professional before making any trading decisions during beta testing.
3. Any information made available during beta testing is provided on an as-is basis for testing convenience only.
4. Beta testing participants acknowledge that all information, signals, and data provided are experimental and for testing purposes only.

17. Miscellaneous

1. Super8Trends reserves the right to change these Terms. When we change these Terms significantly, we will notify beta testing participants by email and post a notification on our Website.
2. If we do not enforce parts of these Terms, this cannot be construed as consent or waiver of the right to enforce them later.
3. Beta testing participants warrant and represent to Super8Trends that:
   • You have the power to enter into this Agreement and this Agreement constitutes a legal, valid, and binding obligation
   • You are acting on your own account
   • Your participation in beta testing is not prohibited by law in Thailand
   • You are a legal resident of Thailand

18. Severability

The invalidity or unenforceability of any provision of these Terms shall not affect the validity or enforceability of any other provision of these Terms. Any such invalid or unenforceable provision shall be replaced by a provision that is considered valid and enforceable and which interpretation shall be as close as possible to the intent of the invalid provision.

19. Applicable Law and Jurisdiction

1. This Agreement is governed by and is to be construed in accordance with the laws of Thailand. You irrevocably agree to submit to the exclusive jurisdiction of the Courts of Thailand in respect of any matters arising out of this Agreement.
2. You acknowledge that this Agreement sets out the entire agreement between You and Super8Trends in respect of beta testing participation, and all other arrangements and understandings are superseded by the terms of this Agreement.
